South Carolina Drug Charges Can Escalate Quickly

South Carolina drug offenses are commonly charged under S.C. Code § 44-53-370, which covers a wide range of conduct involving controlled substances, including possession, possession with intent to distribute, distribution, manufacturing, and trafficking-related offenses. The same statute also makes clear that penalties can vary significantly depending on the substance and the quantity involved.  

That means the exact charge matters, but so do the facts behind how the stop, search, and arrest happened. 

Possession, Distribution, and Trafficking Are Not the Same

One of the most important things to understand in a South Carolina drug case is that not all charges are treated the same. 

A case involving simple possession may be charged very differently than a case involving possession with intent to distribute, distribution, or trafficking. In some situations, the amount of the substance alone can affect how prosecutors view the case. South Carolina law also states that possession with intent to distribute can be treated as a lesser-included offense to certain trafficking-by-possession charges, which shows how quickly a case can become more serious depending on weight and circumstances.  

Even Small Amounts Can Still Lead to Charges in South Carolina

People are often surprised to learn that marijuana is still illegal for recreational use in South Carolina. 

Under S.C. Code § 44-53-370(d)(4), possession of 28 grams (one ounce) or less of marijuana can still be charged as a misdemeanor. A first offense may carry up to 30 days in jail and a fine, with higher penalties possible for later offenses.  

That does not mean every case is handled the same way, but it does mean that even a charge involving a relatively small amount can still create serious legal and personal consequences.

Not Every Drug Arrest Leads to a Conviction

A drug arrest is not the same thing as a conviction.
