South Carolina Divorce Law Includes Specific Grounds and Residency Requirements

South Carolina recognizes both fault-based and no-fault grounds for divorce. 

A no-fault divorce is based on living separately and apart without cohabitation for at least one year. South Carolina law also recognizes fault-based grounds such as adultery, habitual drunkenness, physical cruelty, and desertion.  

South Carolina also has residency requirements before a divorce can be filed. In general, if both spouses live in South Carolina, one spouse must have lived in the state for at least three months before filing. If only one spouse lives in South Carolina, that spouse generally must have lived in the state for at least one year before filing.
